By creating an account, accessing, or using our Service, you agree to be bound by these Terms. If you do not agree to these Terms, you may not access or use the Service.

We reserve the right to modify these Terms at any time. We will provide notice of material changes by updating the "Last updated" date. Your continued use of the Service after changes constitutes acceptance of the modified Terms.

2. Description of Service

Riten AI provides an AI-powered platform that enables users to:

• Generate blog content using artificial intelligence technology
• Connect and sync product data from e-commerce platforms (Shopify, WordPress, etc.)
• Schedule and publish content directly to connected platforms
• Manage and organize generated content
• Access SEO optimization and analytics tools

We reserve the right to modify, suspend, or discontinue any part of the Service at any time, with or without notice. We are not liable for any modification, suspension, or discontinuation of the Service.

3. Account Registration

To use certain features of the Service, you must create an account. When creating an account, you agree to:

• Provide accurate, current, and complete information during registration
• Maintain and promptly update your account information to keep it accurate
• Maintain the security of your password and accept all risks of unauthorized access
• Immediately notify us if you discover or suspect any security breaches
• Take responsibility for all activities that occur under your account

You must be at least 16 years old to create an account and use the Service. By using the Service, you represent that you meet this age requirement.

If you are using the Service on behalf of a business or organization, you represent that you have the authority to bind that entity to these Terms.

4. Subscription and Payments

4.1 Plans and Pricing

We offer various subscription plans with different features and usage limits. Current pricing and plan details are available on our pricing page. We reserve the right to modify pricing with 30 days' notice to existing subscribers.

4.2 Billing

Paid subscriptions are billed in advance on a monthly or annual basis depending on your selected plan. Payment is processed securely through Stripe. By subscribing, you authorize us to charge your payment method on a recurring basis.

4.3 Free Tier

All accounts include a free tier with 2,000 words per month. No credit card is required to use the free tier. You may upgrade to a paid plan at any time for additional features and usage.

4.4 Refunds

Subscription fees are non-refundable except as required by applicable law. You may cancel your subscription at any time, and access will continue until the end of your current billing period.

5. Acceptable Use

You agree not to use the Service to:

• Violate any applicable laws, regulations, or third-party rights
• Generate content that is defamatory, obscene, threatening, harassing, or hateful
• Create content that infringes on intellectual property rights
• Generate spam, misleading content, or content designed to deceive
• Attempt to gain unauthorized access to our systems or other users' accounts
• Use automated systems (bots, scrapers) beyond our provided API
• Interfere with or disrupt the integrity or performance of the Service
• Circumvent usage limits or billing mechanisms
• Resell or redistribute the Service without our written consent

We reserve the right to suspend or terminate accounts that violate these terms without notice or refund.

6. Content and Intellectual Property

6.1 Your Content

You retain ownership of all content you upload to the Service ("Your Content"), including product data, images, and any original text. You grant us a limited license to use Your Content solely to provide the Service to you.

6.2 Generated Content

You own all content generated by our AI based on Your Content ("Generated Content"). You are free to use, modify, publish, and commercialize Generated Content without attribution to us.

AI-generated content may contain errors, inaccuracies, or outdated information. You are solely responsible for reviewing, verifying, and editing all Generated Content before publishing or distributing it. Riten AI does not guarantee the accuracy, completeness, originality, or suitability of Generated Content for any particular purpose.

6.3 Our Intellectual Property

The Service, including its design, features, code, AI models, and documentation, is owned by Riten AI and protected by intellectual property laws. You may not copy, modify, or create derivative works of our Service.

6.4 Feedback

If you provide feedback, suggestions, or ideas about the Service, you grant us a non-exclusive, perpetual, irrevocable license to use such feedback for any purpose without compensation.

7. Copyright and DMCA

We respect intellectual property rights and expect our users to do the same. If you believe content on our Service infringes your copyright, please submit a notice to legal@riten.ai with: (a) identification of the copyrighted work; (b) identification of the infringing material; (c) your contact information; (d) a statement of good faith belief; and (e) a statement of accuracy under penalty of perjury.

We may remove or disable access to allegedly infringing content and may terminate accounts of repeat infringers.

8. Third-Party Integrations

The Service integrates with third-party platforms and services. Your use of these integrations is subject to the respective third-party terms and privacy policies. We are not responsible for:

• Third-party service availability, accuracy, or reliability
• Changes to third-party APIs or terms that affect our Service
• Data handling by third-party services
• Content generated by third-party AI services

9. Disclaimers

THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT.

We do not warrant that:

• The Service will be uninterrupted, secure, or error-free
• Generated content will be accurate, complete, or suitable for your purposes
• The Service will meet your specific requirements or expectations
• Any errors in the Service will be corrected

AI-generated content should be reviewed before publication. You are responsible for ensuring Generated Content complies with applicable laws and does not infringe third-party rights.

10. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, RITEN AI SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING BUT NOT LIMITED TO LOSS OF PROFITS, DATA, USE, OR GOODWILL, ARISING OUT OF OR RELATED TO YOUR USE OF THE SERVICE.

OUR TOTAL LIABILITY FOR ANY CLAIMS ARISING FROM OR RELATED TO THESE TERMS OR THE SERVICE SHALL NOT EXCEED THE AMOUNT YOU PAID US IN THE TWELVE (12) MONTHS PRECEDING THE CLAIM.

11. Indemnification

You agree to indemnify, defend, and hold harmless Riten AI and its officers, directors, employees, and agents from any claims, damages, losses, or expenses (including reasonable attorneys' fees) arising from: (a) your use of the Service; (b) Your Content or Generated Content you publish; (c) your violation of these Terms; or (d) your violation of any third-party rights.

12. Termination

You may cancel your subscription at any time through your account settings. Cancellation takes effect at the end of your current billing period.

We may suspend or terminate your account immediately if you:

• Violate these Terms
• Engage in fraudulent or illegal activity
• Fail to pay subscription fees
• Create risk or legal exposure for us

Upon termination, your right to use the Service ceases immediately. You may export Your Content before termination. We may delete your data 30 days after account closure.

13. Governing Law and Disputes

These Terms are governed by the laws of the State of Delaware, United States, without regard to conflict of law principles.

Any disputes arising from these Terms or the Service shall be resolved through binding arbitration in accordance with the rules of the American Arbitration Association. You waive any right to participate in a class action lawsuit or class-wide arbitration.

14. General Provisions

• Entire Agreement: These Terms constitute the entire agreement between you and Riten AI regarding the Service.
• Severability: If any provision is found unenforceable, the remaining provisions continue in effect.
• Waiver: Our failure to enforce any right does not waive that right.
• Assignment: You may not assign these Terms without our consent. We may assign our rights and obligations.
• Force Majeure: We are not liable for delays or failures caused by circumstances beyond our reasonable control.
